VA Loan After Foreclosure or Short Sale

Short answer: A prior foreclosure doesn’t disqualify you by itself. VA regulations tell lenders to apply the same framework as bankruptcy: recent events need re-established credit and circumstances beyond your control (38 CFR 36.4340). If the lost home had a VA loan and VA paid a claim, some entitlement may be unavailable until the loss is repaid, but remaining bonus entitlement can still allow a purchase.

Waiting period

VA regulations apply the bankruptcy guidelines: events within the last 12 months are hard to approve, and 1–2 years needs re-established credit plus a verified cause beyond your control (38 CFR 36.4340).

What happens to my entitlement?

Per 38 CFR 36.4340, entitlement can’t be restored until VA’s loss is repaid in full, even if the debt was waived or discharged in bankruptcy. In high-cost San Diego, remaining entitlement can still be meaningful. See VA jumbo & limits.

Short sale vs foreclosure

Both are reviewed case by case, and the facts and circumstances matter. Bring a clear written explanation.

Frequently asked questions

Can I get another VA loan after a foreclosure?

Yes. A foreclosure doesn’t disqualify you by itself. Lenders weigh timing, re-established credit, and the cause, and your remaining entitlement determines the guaranty.

Do I lose my VA entitlement after foreclosure?

The entitlement tied to the claim is unavailable unless repaid, but any remaining entitlement can be used.

Does Hyde Funding work with past foreclosures?

Yes. Every credit profile is welcome. If you need deeper credit work, we can refer you to a trusted credit repair partner.
